My son-in-law received a final paycheck for a construction company he worked for. He deposited the check in his account and wrote checks against it to pay bills. The pay check bounced and now he is responsible for overdraft fees in his account at the bank. The contractor has agreed to cover the bad check but not pay the additional fees. Under what law can he take the contractor to small claims court to recover the overdraft fees and any additional damages?

I think you can still consult an attorney in Michigan for something like $10, I think it would be worth the investment. Small claims does not require an attorney but the legal question would be better ask. I personally would say yes as he is the injured party, and should be able to receive compensation for it.

How much are the additional fees? It would probably cost him more to pursue it. There are filing fees and service fees and all sorts of fees to do it, plus the time and effort it takes to go to court.I hate to say it but that contractor sounds like a putz! If he were any type of business man, he would make it right. Good luck.
