There should be some form of evaluation of them to determine their guilt or innocence. I'm certain there are a minimal amount of innocent people incarcerated by our government. These people have families that need them. As for giving them the rights that we have here in an American court of law, well it is WE THE PEOPLE and our families that have suffered through far worse wars than this one to gain these rights. So while the suspected terrorist sit in prison......let them think about why we are protecting our way of life and why they don't get these same rights. The world that a terrorist envisions is not one of innocent before proved guilty.

Americans deserve a fair trial by our constitution...but the questions we have to ask...with the ACLU and the media in the picture are the trials fair to Americans or just the terrorist? We are at war & Americans are being killed everyday - we need to do what ever it takes to protect Americans & the USA - the h * ll with being politically correct!

Good question. I don't think they should get a civil trial by jury (though the thought of a "jury of your peers" terrifies me. Just look at some of the close-minded idiots that post here for the reason why) but to be held indefinitely is just wrong. Some of those people we have captured are innocent, and are having years of their lives stolen from them by our government because they are not given due process in a reasonable time. I know I would be unforgiving if it had happened to me.
Whether it is a military trial, tribunal, or whatever it is, we need to do SOMETHING much more quickly than we are now.

Holy Mackerel. For the first time in months, I find myself agreeing with Answerman. I hope that this doesn't cause some kind of cosmic rift and destroy the universe.
The powers that be have declared that this is a WAR on terror so I think that the enemy combatant should be considered to be exactly that and held as prisoners of war in a secure facility until the conflict is over, NO MATTER HOW LONG THAT TAKES.
Additionally, just like what happened at Nuremberg at the end of WWII, when the war on terror is finally ended, and international tribunal should be established to determine if any of these enemy combatants have committed crimes against humanity, and if that is determined, they should be tried for those crimes and proper punishment should be meted out to those who are convicted.

I think they should be treated as pow's that is what they are. All human rights but not civil rights. They should have access to things like the red cross, and I think they can be kept as humanly as possible until the issue of terrorism is resolved. This does not include a trial, unless suspected of war crimes and if that is the case they should then be turned over to the international community for trial on these and our case made.

Outright proven terrorists, no I do not think they deserve the same rights.
Those who are simply suspecting of being POSSIBLY involved with terrorism, should get a fair trial.

Yes I think they should.That shows the whole world that and why we believe in our values and that things as democracy and rule of law are superior to any form of barbarism.
If we don't act like the civilized countries we are we'll never have credibility again to tell the rest of the world they should respect human rights.Then that would sound like do ad I say not as I do.

They should held in the country they were captured in to stand trial America has to stop being the worlds police force we are loosing to many men and women to war.

I think everyone should have a fair trial for two reasons:
1. We must demonstrate to the world that we are a just nation. The struggle against terrorism can only be won by winning the hearts of those who now hate us, and how better to do that than to showcase our freedoms?
2. I believe our freedoms make us strong, not weak. Lots of people seem to think that at the first sign of struggle, we should toss aside our freedoms. However, what that really means is that they think our freedoms make us weaker. I disagree. I think we have endured as a nation so long not despite our freedoms, but because of them.
