Does anybody else out there view CPS as an unconstituional organization that needs to be completely overhauled and rebuilt? If found unconstitutional, which happens in federal courts almost every time, why are we still funding this broken, family destroying program and the incompetent morons who run these programs? Does anybody know and actually like any CPS caseworkers? Does anybody else believe that these CPS types carry alot of emotional baggage and think that they are paid to project their issues through transference onto the unsurpecting public? Is CPS, as a whole, a good or bad idea?

+LOL CPS caseworkers and social workers need not respond. I already know your response and can recognize a ss type a mile away. I want opinions from the public taxpayers not govt. employees who "believe" they are needed.

You bet it is..... the few cases they ligitimately handle in the best interest of the child and family are far outweighed by the many families they ruin in the interest of bureaucrats "looking busy".
Try sending them this one: (a very basic 1st amendment and common law right)

Comes the declarant, pro-persona, and herein states:
On or about (date) (name of CPS agent) entered my home and persuaded me that if I did not sign certain documents agreeing to terms of a “voluntary contract” with CPS she would take immediate custody of my child(s), (child’s name). As the natural mother of (name) and in the absence of council on my behalf I was forced under threat of loosing immediate custody of my child to sign the contract(s) with State of (state) Child Protective Services.
On or about (date) I was asked to come to CPS offices for a meeting with CPS personnel and when I asked if I may have an attorney present I was denied that most fundamental right, a right guaranteed by the U.S. Constitution, the (state) Constitution, and the (state) Administrative code. I have discovered that all these ploys are used by CPS in an effort to elicit “voluntary” compliance contracts to CPS policy, not in fact state or administrative law.
Signatures obtained on contracts under any jurisdiction are void if obtained under threat, duress, coercion, fraud, or illegal acts. My signature(s) as received by agents of the CPS were so obtained.

I herein rescind any and all signatures obtained from me by CPS as having been obtained under threat, duress, coercion, and fraud. Said signatures as of this date being void, the fraud eviscerating any actual or implied contracts. I also herein rescind all signatures on any forms now in possession of CPS or their agents.

For purpose of identification all future signatures by me on any CPS documents will be followed by the initials “TDC” to signify the signatures were obtained under threat, duress, and coercion.

Any allegedly “voluntary” contracts I entered into with CPS are now null and void. My freedom to participate in a lawful family atmosphere and raise my child in a reasonably safe environment the way I see fit is not a privilege, issued by State agencies, it is a fundamental human and constitutional right.

I believe sincerely CPS has in fact and in spirit been operating in an atmosphere of fraud and deceit and as such are operating outside the laws of (state). The U.S. Supreme Court has on numerous occasions ruled that agents of the state operating outside the law no longer have immunity from civil action and compensatory damages.

Any further attempts on the part of CPS or it’s agents to harass or intimidate me will be met with immediate civil action.

I swear under penalty of perjury the forgoing is a true and accurate statement of the facts, to the best of my knowledge.

The CPS is a good idea but at current time they do need to have a change of staff in their high rankings also I have seen first hand that the caseworkers who respond to these problems do help to remove children that are put in bad situations because of parents that are so doped out on heroin,crack ,meth these case workers do a good job however some take it to extreme and should be retrained,A majority of the general public just sit back and say hey it is not my problem but you know it is your problem you are a tax payer paying for these programs and you should report bad situations when involving children or elderly.

It is unconstitutional. I see very well how cases are pre-printed verbatim copies of what the "law" (state laws) must occur prior to removal, to detain the children, to obtain jurisdiction, etc. I have seen social workers omit what would have kept the children at home, outright lie on court documents and weasel any which way to make ANY circumstance appear to be under the WIC law, be twisting and elaborating tales of nonsense. Seriously, a LD that is discriminated against by regular citizens, cops and judges, and SWs THEMSELVES, has been made to be an allegation of child abuse of the parent, for failure to protect. Nevermind ADA, nevermind THE CONSTITUTION OF THE UNITED STATES OF AMERICA, because we have SWs who have and will continue to be doing whatever they wish and consider it legal. I personally know one SW from the Mabe case...she's still up to unwarranted removal, at least according to documents in the same county's courthouse.

you sound bitter. No system is perfect but to allow children to remain in homes that are violent is not okay. I hear you spouting off but offering no solutions. We need a proactive way to address how to best support children in need. Blaming CPS workers for doing their jobs is counterperductive - funding is a real issue. If we funded children services with the same commitment we fund the military maybe systemwide changes could occur.

Try having been the child who needed CPS.
Try being my dad, who needed them to interview me in the 1980's before rescuing me.
Try being the parent, unaware that she's physically very hormonally ill, who makes darned sure not to go too far with the uncontrollable mood swings because as uncontrollable as they are, CPS could make sure she never had to control one again. (And then find out, thank god, and not even have to worry about it anymore.)
Hmmm.
I'll pay for this. I'll pay for this because there' s no social support systems. We're so damned afraid to get involved in even our families' lives, let alone our neighbors, that many people do not help each other, criticize each other, and force each other to get help for the kids' sake.
We all want to be so independent.
Many grandparents just want to see the kids when they want to.
Many people just want to handle their own stuff.
And these kids get lost in the fray.
Geez, we can't even rely on the bank teller to be the one to tell our kids to not swing on that velvet line divider. Kids won't listen their own parents, because they hear it so often they tune it out.
We need communities to raise children,
but we just refuse to let ANYONE else even MILDLY admonish our children.
Forget about watch them, give us a break so we can de-stress.
So, if we really all wnat to be this cut-off from each other, then yes,
LET'S PAY FOR THE CONSEQUENCES.

Here in San Antonio TX they have failed tiem and time again.....and it has cost lives of children....needs to be overhauled quickly
