will i be able to collect social security on my kids... because he won't be paying me child support while in surgery

If he is on disability and you have a court order - the state will deduct it from his check.

Doesnt he have insurance through his job? If not SS will not pay for the childrens welfare and you may have to seek public assistance to supplement your income.
Is he permanantly disabled or is he just going in for a simple operation like apendix or gallbladder?
I dont think that SS will give you money as long as one of the parents who is supporting them has the ability to get a job and provide income. Notice that I said "the ability" . It doesnt take into consideration that you have no daycare or babysitter and may be making it barely now. As long as you can hold any type of job, you are on your own.
I am sorry, and I may be wrong but if your husband isnt getting SS then you wont be able to either unless you become disabled.

If he is on SS then yes,other wise no.He will get a wavier from child support and wont have to pay you a penny till he is back to work.
