If you're in the US, yes.

US Code TITLE 18 > PART I > CHAPTER 40 > § 842
(j) It shall be unlawful for any person to store any explosive material in a manner not in conformity with regulations promulgated by the Attorney General. In promulgating such regulations, the Attorney General shall take into consideration the class, type, and quantity of explosive materials to be stored, as well as the standards of safety and security recognized in the explosives industry.

Basically, it's completely at the Attorney General's discretion as to whether or not you're storing the explosives properly. I'm willing to bet which way he would go on this one.

LOL - an odd question with an stranger answer coming.

If you are in Chico, California. they have on their books, the rather interesting law stating:- "Detonating a nuclear device within the city limits results in a fine of $500.

So presumably even if not legal, if you refrain from detonating it, you should reasonably expect the fine to be less than $500.

Not on that basis alone. However, most judges would award warrants to police on the basis that Having it is intention to use. Why else would you have a hydrogen fusion device?

I'm just hoping this is a hypothetical...

I would think that they could, considering there is only one use for a bomb, or even having a bomb.
