My husband's ex wife hacked into our personal and business e-mails. She is trying to use the information in those e-mails to black mail us into paying her more child support. Is hacking into a persons e-mail illegal? What are the penalties for doing it? Is the information obtained admissable in court? Thanks

Some additional information:
She gave our e-mails to her attorney and also to our attorney. She admitted to me that she did it and said because he used a password that he used when they were married, she did nothing wrong. The e-mail account was set up after their divorce and she has been reading those e-mails for over a yearl

Very illegal and you can also sue her for civil damages.

It kinda depends, did you allow the person access to the Files. If you did, it wasnt an illeagl hack.
Is some grey area there, but by law, it is Wire Fraud to obtain data that does not belong to you.
It is a Felony to to Extort Money, see RICO.
If the information itslef is illegal, thats your mistake. But the acquisition and gathering of the data is against the law without a warrant or a FISA Court Approval.
Anything once spoken about in open Court is and can be used as Evidence. That is an OLD legal trick.

then she didn't hack. she had a password that was known to her, and your husband didn't bother to change it. if she knew the password, then its assumed that she was given the right to check that email account

you can go to your lawyer and tell him/her that she used information taken from that account to black mail you (that's illegal). You'll have to prove that she is blackmailing you (ie plans to release private information, unless she gets more money).

HOw old are the children? If she is showing to a badcharacter, you can also try to get a change of status as to whom should have the kids. If she's threatening blackmail, you can use that against her to gain custody of the children and demand child support from her.

that information is not admissible in court and she can spend time behind bars this will backfire on her and your husband can end up with custody try to get her with the assistance of the detectives at the local station they should help as hacking is a criminal offense and so is extortion get those kids away from her she is a wack job
