I filed for a divorce, so I am legally seperated. I am with another guy now. We had a child together. However because I was married at the time of my delivery, my child got my soon to be ex-husbands last name. My ex-husband asked for a DNA Test for child support reasons. The DNA came back that the EX is NOT the Father! But here I am stuck. Since he is not the father and I am with the childs father, how do I go about getting her last name changed to her biological fathers last name? Do I just have to go to the Health Dept in the county she was born and give it to Vital Records and get a new birth certificate? Go before an attourney? Please help me.

I am in the same situation. except my ex is the father. I went to the court house, and yes you do need to go before a judge to change the name. Here where i am we were told it will be 80$ to file the paper work. I suggest you go to the civil department of your local courthouse and ask for the information. They should have packets that have all the information you need. Also i am sure that youll need proof of the fact that your ex is not the father.

You will need the birth certificate and a lwyer to go to court and have the baby's name changed. Don't know why you just didn't put the baby's father's on it from the start but go to the court and and a judge will have you change it

Call the Courthouse in your county. Explain what you need done and they will tell you how to go about doing this. I do not think you need a lawyer to do so (at least as an adult you don't). I called mine the day my ex remarried. Asked them how much and how to do it. They told me $7.50. I was there in 18 minutes!!
