No federal law that I am aware of--the Family and Medical Leave Act does not cover employers that small. Perhaps a state law???

Small businesses with less than 14 people are exempted from many of the labor laws that govern medium and large businesses. The do not have to give family leaves of absence for maternity or for that matter anything else. They can also ignore many of the ADA laws. It was deemed that enforcement of the laws would put excessive financial burden on small companies. Many take advantage of their employees through the use of these exceptions.

In general it depends on where you live, if in the US what state.

But in many there are no real laws, except to use the sick days and vacation days you have earned and saved up.

In general unless you have company leave, any leave would be unpaid of course.

It is called the FMLA...family medical leave act. Per the law, they must keep "a" position open for you, not necessarily your position.
