Ive been married for 5 yrs and i suspect my husband has been cheating from some time now but I have finally made up my mind and i wanna Divorce his sorry *** but I dont want him to take a thing from my house. Hes the situation I am from Puerto Rico I am a nurse and he is a paramedic he makes much less then me. The house we live in is my mothers and i have an suv in my name and a motorcycle in my name as well, the motorcycle is his and he pays it. but really we dont have anything in both our names. I need advice on how i can get a Divorce and him not take anything not even his clothes that r in this house. I want him 2 feel pain. I have pics of him with another woman, but the women r only touching his leg ( is that really evidence ). What should I do? Oh and we have a 2 yr old daughter together.

Everyone here says move on and don't think about how to make him suffer. But THEY haven't been cheated on. I'll bet if their partner surprised them with VD or had bought a HOUSE for some bimbo, then they'd sing a different tune.

Since I have been there- I can comment that I DO understand what your feeling. Legally, you can still do alot. Anything of his in that house can be destroyed. Get boxes & boxes of rit dye and make everything he owns neon pink!

Get every valuable piece of paper of his (birth certificate, SS card, tax returns, everything) and put it in YOUR separate safe deposit box. You will use this as a hostage to get him to admit to the adultery IN WRITING.

This will make it easier for your attorney to get a fault based divorce through the courts. (Courts will want to push for a no fault because it's easier on THEM.)

Your daughter deserves a better role model than her dad. We don't want HER to grow up and think cheating is normal and acceptable. Your anger over this is very understandable and should not be suppressed. It could lead to depression and loss of self-esteem to lay down like a doormat.

Discuss this with an attorney but be ready for the reality that he's entitled to certain things regardless of whether he was faithful. Stay calm and keep in mind that your daughter will soak up your behavior like a sponge. You need to be civil and get through this. Don't fight him over whether he can have his clothes or not. If you're fair, that will be better revenge than freaking out and losing in the end. Then he wins,and you're bitter, but it's over.

Ok, here's the kicker: you have a 2 yr. old daughter that you are a ROLE MODEL to. Please play the adult here. Consult an attorney. Explain to your daughter that daddy still loves her and mommy still loves her, but you won't be living together anymore. Remember this man is your husband and the father of your daughter. Don't screw up the relationship so badly that she is the one who pays until she is an adult. She needs you. You don't need him, fine, but be a grownup for her sake.

First of all it pretty much depends on what state you live in as they all have different "community property" laws. Secondly if he was part of the marriage (and as your husband that would make him so) whether you like it or not he IS entitled to part of the marital assets whether you live in a community property state or not. You should talk to a lawyer as to division of property in your state as well as custody/support for the child.

But, do not forget about the child. The children seem to be the forgotten ones.

What is in the best interest of the child, war or peace?

Divorce him!
