There is a snake in my back yard he is about 4 feet and he is black. Last year we found part of a rat and recently i have been noticing snake skins. What should i do. Also i live in new york and i want to know what to do because many lil kids live in the area. Oh yeah could it be poisunious. I dont want to take it out of its habitat. But,is that the best thing to do?? Please help me with any information you can. Also what could happen if it bit a child would the blame be placed to me for not saying something. Thank you for any information that you can give and if you could please try and give me anything that you can to help me know.

I live in Tn and there all kinds of black snakes here. For the most part they are harmless. They are not poisenous.If you get bitten you will get sick but it isn't life threatening.They are known for keeping poisenous snakes and rodents away.If you don't like the idea of the snake being there your local animal control should be able to help. Unless you live in a region of the country that has perpetually warm weather, it's difficult to imagine ANY snake being out of hibernation/brumation this time of year. Still, the only really black snakes we have in the US are non-venomous Black Ratsnakes and Racers, which are not capable of harming a human, not even a child, and would just as soon avoid conflict with humans if at all possible. While the snake may have been the one who left the shed skins, it did NOT leave "part of a rat", since snakes have no means of tearing up or dismembering animal prey, but have to swallow their food whole and in one piece. Whatever killed the rat, it wasn't a snake. Both Black Racers and Ratsnakes feed primarily on rodents, and do a great job of controlling rodent populations, moreso than cats, birds of prey and other predators combined, since snakes can get down into the little buggers' burrows where they live and breed. Be also aware than in some states, both of these species of snakes are protected by law and you risk heavy fines and jail time for harming one. It's just too bad that there are still rectal orifices like the guy who suggested chopping off its head with a hoe and bragged about doing so many times; hopefully he'll catch some rodent-bourne disease like Bubonic Plague, which would indeed be a fitting fate to such an idiot!

I can't imagine what type of snake is still active in New York outdoors at this time of the year. It's way too cold for snakes to be active here in western Pa. now. I also don't know what part of a rat has to do with this snake. Snakes do not bite off bits of their prey, they swallow it whole. They can't bite pieces off, their teeth aren't made for chewing or ripping. This sounds like a black rat snake or a black racer, both non-venomous & totally harmless to your & any kids around. This snake should be sound asleep till sometime next spring & not be any kind of danger or problem to you.

AND.....if you want it to go away, clean up your damn yard. Both black ratsnakes and black racers will take down rats and mice for meals. Clean up the yard=less rodents=less snakes. And by the way, if the snake wasnt there eating the rodents, the rodents will be the next thing out of controll your complaining about. Think about it. Oh yeah. to the guy who said he chops the heads off of lots of snakes...........snakes such as these eat rodents, just like cats do. You chop the heads off of kittens too, jerk????

Leave it alone , the snake will go away .

I would call animal control and have them come look at it just to be safe. You can't get in trouble if someone gets bit by it because it is not your pet. But don't wait until someone gets bit to call animal control. Take care of it soon.

If it is all black it won t do anything bad but if u don t like it theanimalpark or an animal police but u have to pay them $225 for them to take it

leave it alone you should be find if you leave it alone most snake bite come from people try to pick up the snake or are pestering it

i would call a local vets or a wildlife place because they should give you info on what to do and what type of snake it is and if it is poisonous or harmless.
