Last time I promise!

Okay, so I'm writing a report on Thank You for Smoking, and I have pinpointed four things that the main character did to discuss in my paper. Would you please tell me if what I have is correct? I'm not sure how trustworthy some of my sources were, and I'm having trouble finding better ones.

His first major offense was talking to minors about smoking when he went in to Parent’s Day at his son’s school. He does tell them that rather than believe what everyone tells them, they should find out for themselves. Although this is highly unethical, it is not illegal as Nick doesn’t actually tell the children in Joey’s class that they should smoke or its okay to smoke.

Next, he was sent to bribe Lorne Lutch with a large amount of money if he would stop speaking against tobacco. This is not technically illegal. Of course, the Academy said it never intended the money to be a bribe, just a gift. This would be illegal if Lutch was a public official, but he wasn’t.

Nick also was guilty of divulging proprietary information to Heather. This would be illegal as breach of contract if he had signed a non-disclosure agreement with the Academy of Tobacco Studies. We do not know if he did or didn’t commit to such an agreement, but we do know that it cost him his job.

Although Nick did ruin Heather’s professional career as a journalist by confessing his affair, it cannot be considered defamation because what he said was true. The law states that truth is a complete defense to a defamation claim.

With my first point, about the kids, is there a law that says you can't solicit to minors about smoking? Where can I find it if there is?
And, if you see any problems with any of my other points, let me know what I need to do to fix it.

Goswin, I'm just doing a report here...... It's about how unethically cigarette companies behave. I don't support them. I'm just not a law student, and that's why I need help finding out what's illegal and not. Of course I know it's wrong.

there are lots of ways to "find out for yourselves" he could be accused of encouraging the children to study hard and go into medical research.... does he actually say "you should take up smoking"? or something similar... if all he said is... dont believe what you are told and find out for yourselves... then he is on par with a lot of university lecturers who advise their students to do exactly that.....

it is only soliciting if he is telling them to take up smoking..

You seem to be concerned about the legality of things instead of right and wrong. During the ww2, it was perfectly legal to stuff Jews into the oven. You should think about what´s right too and not just legal. It should be clear to everyone that smoking is bad, it is never okay to try to puff smoking to kids or give suspicious "gifts" to make someone use whatever affluence to benefit the bribers cause. Tobacco manufacturers, sellers and spokesmen are evil creatures that live by the other peoples´s suffering and death. If you want to fight for some cause, i´m sure you can find something more worthwhile. Crooks don´t need help or understanding, they´ll do it anyway. Don´t support a bad thing. Or did he offer you something too...?

Depends who you are... and probably what the state Code is on the topic of ...look up "contributing to the delinquency of a minor."

well in my part of the usa thats considered 1,corruption of a minor 2,intentionally giving a minor a verbal acceptance to break the law. good prosicutors arent paid well enough in some states.
