I am the owner, I am not renting. There is a management company which I pay an annual fee for a block insurance policy. How do I make a claim for this? If the water is coming from outside my apartment is it the management company policy , my own or the owner of the apartment above?!

first off talk to the owner above and see if he left something on. then contact the company stating you need the forms to make a claim

Sounds like a condo vs. an apt ...

The owner above is probably responsible, but it will probably take legal action to get any settlement. I would file a claim with the mgmt company and the owner above and see who pays up.

In your block insurance policy, there may be provision for legal advice. In any case, contact them first, giving exact details of dates, circumstances frequency, damage done etc. However, you need to notify the occupants above that there is a problem and give them a chance to deal with it. Tell them that they ought to notify their insurers and that you will be making a claim for damages.

let the managment do they job and you go to find the owner of the apt above you and tell him to fix the prob and pay your damaged things.

Talk to the landlord of the people of above you they should do something about it...
