Well it could be coming from between the apartments but the leak is directly below the bathroom of the apartment above me, but how do you prove it. How do I resolve this as the landlord of the apartment above is being difficult - he is saying its a pipe in between the floor of his and the ceiling of mine - unlikely I think. Is it to be claimed through the management company or what? Help!

You can prove it by the water stains in your bathroom ceiling. If you have renter's insurance, your insurance company can take care of this by going after the building owner/management.

not sure where you are but in the uk all plumbing comes up from the floor so if the leak is above you it is certain that it is their responsibility, if you both have the same landlord its his problem to fix, contact your insurance company, its in their interest to make someone else pay so their legal people will assess whose liable and get it sorted.
