Most states don't recognize a marriage between the same sex. Massachusetts has attempted to pass laws allowing same sex marriages. The mayor of San Francisco also attempted to allow for same sex marriage. I believe those individuals who were married under the mayor were later found to not be legally married. I am not sure if the law in Massachusetts has been over turned or not. There was a movement at the federal level which would define a marriage as being between a man and woman. Most states have laws against sodomy. Each state determines their own rules but most are similar.

Depends on what state. Some states have a waiting limit (from the time you apply for the license to the time you can get married), some don't. Age and gender limitiations vary by state, as well as common law definitions. Some require you to take blood tests, some require you to take classes so that your chances of succeeding are higher.
