I have another question regarding child support, just so I understand how everything works. I live in Citrus Heights, California and just finished court orders for my son. The father and I are to pay 50% of all necessary medical, dental, or vision expense, etc. I have sole physical and legal custody of my son and father has 0% timeshare. Judge ordered support to be paid by wage assignment and to pay $486 per month commencing on 9/1/06 and arrearage in the sum of $25.00 per month till paid in full commencing on 1/1/07. Just trying to plan for my son's future, because his support will go in a trust fund for him towards high school, college, etc. NOW, What if he doesn't pay at all? What if he only provided one employment and he has 4? Will the courts go after him and put him in jail? I don't want anything like that. I just want him to act responsible for our son, but I can't make him do anything. His parents are disappointed in him and aren't helping him out.

Should I try to talk to him again or shall I let him learn on his own? I only want to help him out but he doesn't listen. You should of seen him in court...He yelled at the judge and the bailiff had to stand behind him. He kept taking me outside trying to drop the child support, but I dropped it in his favors our son would be the one to suffer because of his irresponsibily and immature, right? I'm glad I didn't give into him. I'm only do whats right for our son and standing up for his rights and mine as well.

Support can be reassessed as time goes on and his circumstances change. Normally they ask to see tax returns. I don't know if he can refuse to show them, but if he does the assumption is likely to be made that he is hiding something.

It's really up to you to take the initiative. Someone with California experience will doubtless chime in and say more.

If and only if you complain of nonreceipt, his driving license and passport can be suspended; and he could be imprisoned. (How that helps you collect I don't know; I am aware that some men have spent years and years in prison out of spite, preferring that to paying anything, or to revealing "assets" that quite probably never existed.)

In places like Vietnam and Brazil there are deadbeat dads who spend their lives in bars out of spite.

As long as you're going through child support collection they will take care of it. If he doesn't pay they will garnishe his checks. If he quits his job, they will take his license. If he continues not to pay then they will put him in jail.

if he doesn't pay child support the court will issue a warrant for his arrest. He will have to appear in court and eventually have to pay ALL back child support
