Have not lived with my wife for 8 years..found someone new..

Why do you just want a seperation? If you have been apart for 8 years, why not just file for divorce, especially since you are with someone else??? Anyway.... just go to the court house or some states have it where you can get copies of the legal documents on line. So call the court house first and ask them if they have a website for that. Then after filling them out you will have to bring them to the district court clerk and have them filed, which there will be a filing fee for. I know with a divorce, it will be filed then you have to wait 90 days, and then do the final hearing. I don't know about a seperation. I think a seperation agreement is effective immediately. You might want to look in the yellow pages for a divorce lawyer who will do a free consultation. Lawyers do a very good job of telling you exactly what papers, where, how long and stuff like that. I'm a blonde...... so I preferr to know all the details so I don't screw it up! hahahaha And again..... since it has been 8 years, in your state, it may already be considered a "legal seperation". Just call the court house. District court clerk I believe it is. If not they will tell you who to talk to, but it is usally the district court clerk.

To get a legal separation you will have to go to the courthouse and file for separation they give you like so long to think about getting back with your wife and then if there is no chance of getting back together then you can get a divorce.

You can buy the paperwork online at any divorce site or hire a lawyer to do the paperwork for you. Just depends on how sticky a situation you think it will become.

looks like your already separated. you can go to court and get a legal separation but why don't you just get divorced.
