Superb idea - and it is already done in a tiny way in the US http://www.okplus.com/fedup/ and of course a few other Countries too - Trinidad / Tobago I think still flog the odd back or two.
I think the punishment ought to be used for many crimes which otherwise just clog up the prison system. To help phase it in, I would think allowing criminals the choice of having their back's whipped OR being imprisoned should help to quieten those that say "what about those found guilty by mistake". They still get punished as before (bad news) but now at least have a choice as to being wrongfully imprisoned or wrongfully flogged.
To the people that say it is gruesome and barbaric, in actual fact is is neither. First of all the naval cat and prison cats at worst usually make a few "shaving nicks" on the skin. A sweat soaked back with ONE DROP of blood however can quickly look very messy. The reality is that rope and even leather do NOT do that much damage.
Secondly, what can happen to a young man in a prison can be far more barbaric and soul-destroying than having a tender back for a day or two.
Roman scourges are different - they can kill as they are tipped with bone, glass or metal - but this is NOT what is used these days.
At the risk of being seen to be a few too many bricks short of a full load, I have had a fascination with flogging ever since watching it on "The mutiny on the Bounty" when about 7 years old. A couple of years back, having wondered for long enough what the reality of it all was, I found someone to administer both rope and leather cats to me.
it was a curious experience, and certainly one to focus your mind while it is in progress. However within a couple of weeks there was barely a mark to be seen. FAR less blood than from a leaky nose (a thimbleful at most perhaps), and in my opinion, less unpleasant than a tooth infection.
As for ages, I would suggest 18+ for most offences, but in the case of rape or other violent crime, than at the courts discretion, down to 14. If a person of 14 is old enough to rape someone, they are old enought to be flogged.
As for an upper age, I would suggest that if the person passed a medical to suggest they are perfectly capable of taking the punishment, then an arbitary upper limit is not required.
So there ya go. that's my thoughts on the subject - and thanks for a fab question.

As for not being shown to be a deterrent, I had to disagree. the system mentioned above has a recidivism level of ZERO at present - and if ever you spend time in Malaysia you will find you can walk the poorest parts of the cities at night without ANYONE worrying you at all. People don't tend to come back for a second whipping.

Why not? It would stop a lot of the crimes they do now. It should begin at the time when they become of such age as to do the crime, be it ten or 50. Let it be taught from the first day of life on and they will know what the punishment will be. Do it in the town square where anyone and everyone can come see it go down. Whether it be male or female, bare them to the waist and tie them to a post in the middle of the square with a sign detailing the crime they are guilty of. At the set time, they should be given the lashes they have earned and then the warning given that anyone that breaks the law will get the same. It would put a stop to the crimes that are filling our prisons. Anyone that does not believe it works, see what has happened where it is practiced. There was a big story about an American that got caught up in it and it went around the world. But the crime rate there is almost none at all. People respect the law and obey it as they know what will come if they do not. The only reason we don't like that law is we want to do the crimes and as lax as we are in this country, we know most of the time we can get away with it with little or no jail time if we are caught, no time if we are rich enough.

Flogging has not been used in Western culture for many years, although corporal punishment remained an option in Britain well into the 20th century.
There is no proof that this was any better a deterrent; and the fact that it is still used extensively in Muslim countries means that it has not removed crime there either.
We have the right to remove someone's freedom; but in a civilized society, we do not have the right to wound people for retribution. In the US, such punishment is expressly forbidden under the constitution.
