I bid on an item, was up to two months late in paying, lots of reasons not needed, had seller just cancelled bid i would have understaood, however i finally notiied her that i had send the check, and watching it, the day after the check cleared my bank, she cancelled the bid, taking money without sending the item is not legal is it? Cancelling the transaction should have been done much earlier, and before i sent the money, but once the money was sent and she didnt relist the item, she ws holiding it, so she said. ANY legal action i can initiaite? thanks.

Was it through E-Bay. If she was a good seller with a good reputation she should of sent you your item. If I were you I would file a complaint against her through E-Bay in the Dispute center. As a seller myself, I wouldn't wait 2 months for a payment unless the buyer notified me and explained that it would be late.

Email her first. Some sellers do so much business that she may have missed getting your check. Tell her you have the canceled check and would like the item you paid for. Apologize for being late. She can complain about your procrastination all she wants, but the fact remains, she accept your money and you havethe canceled check to prove it.
If she does give you a hard time, leave negative feedback and contact Ebay.

Very strange story but I won't invade your privacy by asking you a million questions. Your first step should be to give her negative feedback and state why. Your second step should be contact ebay and file a formal complaint, the seller will be contacted by ebay and either a resolution will be reached by the seller or ebay will decide for you. You will recieve your money back if you have proof of payment with no reciept of goods.

If in fact you are not referring to ebay. All auction sites have a dispute resolution center as link on the homepage.

i assume it is Ebay. They have a complaints page and will initiate an arbitration for you with the seller. Also, email the seller and let them know that you understand them withdrawing the item after so long, but that they should send you back your money. Other than that, any legal action will probably cost more than than the $$ you've already lost. Good luck.

If it was through eBay you can contact them to take some sort of action. Sorry, but you might not get your money back. Try to contact her too and tell her that you KNOW your check cleared and you'd either like the item or a refund.
