ok you need to use layers in some form - one layer has the picture another has the text

This can be done with gifs (adobe image ready and many other programs and also with flash

Well,

You might want to batch process (a lot of) pictures, inserting a copyright notice and/or logo...

Plenty of programs can help you out with this...

http://www.lunerouge.org/gnu/crl_e.htm ... a freeware application that allows you to put text on a chosen space on the picture. It works fine, but doesn't create "transparent" text (or a business logo).

If you actually want to place an images (f.e. a rasterized text, or a logo) ... there's the freeware application picture-shark. Have a look on their site for more info.

If you want more control over the total process, you can indeed use an application that works with layers. The most famous (but expensive) application would be Adobe Photoshop. But for most photo-editing (and thus also for the imposition of this kind of watermark), you can get almost as far with the Open Source application "The Gimp". The one big downside of this approach (both photoshop or gimp) is the learning curve: the application is capable of doing a lot of things... so managing to do just that, requires you to learn the principles of these applications. It's like swatting a mosquito with a sledge hammer.

You can accomplish this using Movie Maker or Word. In Movie Maker you have to select the overlap option. This will give you many options to where and how you want your text to appear. With Microsoft Word if you paste a picture or insert a picture you can insert a text box and then click on the text box properties and choose bring to front.

Get The GIMP: http://www.gimp.org/windows/

It's a powerful image editing software package that's free. You can load an image and put text on the image. You can also do a bunch of things to the image.
