For example, if I wanted to take custody of my kids and the father of my kids does not contest it, can his Aunt do anything to prevent me from getting custody or fight it in court? Also Should I get a lawyer for this?

If they can prove that you are unfit to take care of your kids, then any person in authority can take them away from you.

Yes, if they can prove that you are incapable of looking
after the kids, say on drugs, handicapped or things like
that. Don't you think its better for the Aunt to bring up the
kids after all she loves them just as much whilst if you
settle the whole thing in a friendly manner you can even
visit the kids whenever you like without having to drag the
whole case through the courts. You can also without the
burden of your kids start out your life again after all there
are so many pebbles on the beach, who knows ?

There are grandparent laws....the grandparents can file for custody. All and all, however...no one can "take" your children away from you unless you can be proven unfit. They can only file for joint custody and would have to have a doggone good reason...You dont have to fight for custody for your own kids...unless youve lost custody. Like I said, if youre proven unfit, yes...you need a lawyer. But theyre expensive. But an aunt? Only if she can prove shes a better provider than your children than you...like your house is dirty, theres no food, you dont have a sufficient income to care for them, etc.

Yes, it is possible. I have known decent fit mothers who have lost custody this way. The legal system is often corrupt and those with the most money often get their way. Mothers are seldom the ones with the most money, so mothers are vulnerable to manipulative people. Yes, definitely get a lawyer. A GOOD lawyer. Better to be overprepared than underprepared and lose your precious children.

It depend where you live.
The best person to ask this ? would be an attorney in your local.
Many attorneys do consoltations (where you can ask this ? and others) which are free or have a nominal fee. Also check you local court web site under family law.
Where I reside anyone can apply for custody of a child regardless of their relation to the child.
