please help were does he have to loock for getting a lien and his money for the work his done the owner that hire him pass away in april so now the wife,daughter,whants to kick us out of the propertie and i ended up pregnant yes his the father the construction worker any ways does any one can tell me who to loock for or call etc.my name is sandy.m. thank you.

Sandy, If your partner had a business license take the owner to small claims court. Have your paper work together in a organized manner showing hours spent on the job site, materials used. any existing contracts that you have with the owner. etc. Try to talk very little in court. let your paperwork do the talking for you. Don't at any point lie to the judge. He has heard it all. Let the owner step on their bullshit!! the judge will know that you did the work and if your paper work is in order probably pass judgment in your favor. You can do this even without a business license. In order to file a mechanics lien you do need a business license. go to your local city court or the city where the work was done and ask, nicely for help. should work out OK.

If you do get a judgment in small claims ... try to get a check while you are still in the court room. Its hard to collect once they leave, even with a judgment.

you can lien it yourself..
go to county recorder's office
they will tell you what you need to put the mechanic's lien on the property
that doesnt get you your money any faster....just guarentees you your money if the property is ever sold or goes into probate or has a loan taken out against it
none of these actions can be settled with a lien in place

Start with the County Recorder's Office. They are the people who maintain such records. If you are polite, they will probably explain what needs to be done.

The next step is to find a lawyer if you must.

This is called a Mechanic's Lien.

Have a lawyer do it for you the first time. Photocopy everything she does and take notes.

The next time, follow her steps and do it yourself.
