it was parked next to my apt. my neighbor was backing up and hit it. She saw the car there as she needs to pass in front of it to get to her garage. my car was not blocking any passageway and only an idiot not paying attention while backing up could hit it. am I any at fault?

Her car was moving, your car was stationary. You may be charged with illegal parking, but the driver of the car that hit your car is the one at fault. You must keep your car in control at all times. She did not, and stuck a stationary object.

If you hit a car that is broken down in the middle lane of the expressway, you would be at fault, even if the car you hit was not "supposed" to be where it was.

She should pay to repair your vehicle!

For most states the way it works is the car that was moving is at fault for the accident. The officer who shows up to the accident to write a report can ticket the other car for being parked illegally but parking that way doesn't justify the other driver's fender bender. For instance I was driving and went around a bend in the road and hit a car parked illegally. I was at fault for the accident and she was cited for her parking. Can you imagine if someone said it's not my fault I hit a person standing in the road because standing in the road is illegal. I am sure you get it.

since i wasn't there i can only go by what you have told us,,but if you was not parked legal,,she can hold you at fault especially if you was in any way blocking her drive way ..the laws sometimes aren't too fair on these matters,,but they do plainly state if you are blocking someones drive way ,and they hit you ,there not at fault,,so on this one i don't know,if you got a ticket for it this makes you legally at fault,but it doesn't mean its right,just do the best you can with the situation,,that's all anyone could do,,good luck,i hope this help,s

I'm sure the insurance company will consider you partially at fault.
It happens all the time. Some companies try to get the innocent parties co. to pay 10% just for being on the road. No kidding. You'll have to pay some if parked illegally. I'd bet on it.

From the information that you've provided, it doesn't sound like your at fault legally. After all, she should've watched where she was going and if her judgement wasn't that great, she should've questioned herself. Because of idiots like that, that's why insurance is so high.

the other person who was backing would be at fault . thats called a citation for improper backing resulting in an accident.

Its not even your concern. Your car wasn't touched, so its not your problem. Kind of a worthless question to ask, and even more worthless to answer. Strange how you could be at fault when it wasn't your property, or even your vehicle involved. Enjoy.
