I think he has every right to sue them! Smoking cigarettes is not illegal. I think the most a company should be able to do is either charge you more for your health insurance if you're a smoker.

Wow. I hate smoking but that was out of line. What would have happened if you just lived with a smoker and always breathed in second hand smoke? That was just wrong.
