A property developer recently dug up, for connection to services, a private road which runs outside a friends house. The private road does not belong to the property develope or the friend. The developer has reinstated the part of the road which was dug up to highway standards but the friend doesn't like the fact that the road is now different colours and wants the property developer to retarmac the whole road. is this what should be expected of the property developer.

Usually, no. If the road works, that's probably the end of the inquiry, and your friend's aesthetic sensitivity will just have to be bruised.

I could see an argument (at least in some jurisdictions) where the road was a decorative road -- like a cobblestone circular driveway -- or had historical significance in its own right. But that would be a stretch.

OMG. Tell "your friend" to get over it. There are much larger problems than the color of the road in the world, and if thats hers, she is one lucky woman. Since it is a private road and was dug up, the developer must have had permission to do so. If the owner of the private road is fine with the situation, what is your friends beef? She has no rights to complain about the color of someone else's private road. Perhaps she could offer up the $3 million or so it will take to re-do the road if shes that concerned.

The friend doesn't own the private road? Then he most likely can't be heard to complain (at least in the U.S. unless the color would constitute a "nuisance" or perhaps the developer violated a restrictive covenant related to road colors that run with the land.)

If necessary works have to be carried out on services they MUST be by law put back to the same or a higher standard than before.... Try dig out this law, call local government offices maybe, then call the person who did the work, tell them about it and give them one last chance to improve the work. If this is unsuccessful then I'd advise the Ombudsman (small claims court), you don't need a solicitor and court fees are minimal (around 10 - 20) should get a call and begin action to have it fixed.

Surely the road wasn't dug up without the owner's permission?
Assuming that they had permission and that the owner[s] is/are satisfied then your friend has no say in the matter and will just have to live with it.
C'est la vie.

god i wish they'd do that to my road!
they did road works outside my house and the road is a terrible state now they never redid it properly if only we had to worry about the colour just.

My husband lays gas pipes inthe road and if they reinstate ground it has to be as near to the original surface as possible.
ie; if they lift cobble stones then they need to reinstate cobble stones
