my son was lets just say he was hurt by a female cousin. she is in counseling as a sex offender. does this mean that she is being charged for the crime she committed against my son she is 12 and my son is 8. do you think that her parents should be responsible for my sons counseling bills that have occured because of what she did. i am petitoning the court to make her publicly apolgize to my son for what she did.C.P.S is sending the case to the grand jury is this a sign that she will be prosecuted?

yes as a matter of fact she did molest him over a period of 2 years his mental state has been affected!!!! she laughs and smerks at all the things she did to him when ask about it! MY SON WAKES UP IN TEARS FROM THE NIGHTMARES!! SCREAMING!~

all i did was report this to cps the rest CPS did on their own, i hope this NEVER happens to someone else but if it happens to YOUR child maybe you can see where i'm coming from. yes she needs help all i am asking is the court make her apolize to my son and say that she is sorry to him and see that she gets counseling. the state decided to send it to the grand jury .all i did was report it

I am not sure what State you are in, but usually juvenile cases do not go before the grand jury and CPS cannot bring a case before the grand jury. Typically, the grand jury is the exclusive province of the District Attorney's Office. You may want to double check with the DA about what is going on with the case. As the victim's parent, they should be keeping you informed. Whether the cousin will be prosecuted and to what extent will also depend on where you live but being in counseling does not mean she is being prosecuted. Counseling is an alternative that CPS has available to them whether or not there are criminal charges. By the way, you did the right thing by making the report.

The Grand Jury will decide if it is going to court. That's why they have Grand Jury's. Further, you can ask the Judge for restitution on the medical expenses paid to you from the family of the minor child as part of the terms of the 12 year old child's sentencing. Meet with the prosecution and see what they are willing to propose. The Judge may feel that this is not necessary or whatever to have these fees paid by the family of the criminal child then you can sue civilly for these said fees.

The grand jury's job is to determine whether or not a crime has been commited and whether or not the state has enough evidence to go to trial. Basically, whether or not she will be prosecuted depends entirely on the grand jury's decision.

Her parents would indeed be responsible for medical damages (including couseling) if a court finds that her actions caused those damages. This won't hapen in the criminal trial, however, unless it's agreed to as part of a plea agreement with the prosecutor. You would have to hire a lawyer and file a civil suit against her parents.

No it does not mean she is being charged or anything. i know how this works.. i was raped when i was little by my 1/2 brother and we went to court and he only got locked up in juvie hall for a year. and when she turns 18 her record will be clean. i do not think thay should do that but thay do.. heres a web site that u can get more help and stuff if u want to

I am so glad you are not in my family. To turn to the court process over a 12 year old...what did she do to your son, rape him?

I agree if wrong doing was done you should have the girls parents pay for the counceling, but to involve CPS, a group 5 times more likely to abuse your child then a family member is seems to be the height of ignorance on your part.

I hope they don't snatch your child from you as well.
