when i was paid my wages on the 28th of november, no overtime which i had worked was paid to me and i was told i would have to wait until the 28th of december.how do i go about the formal grievance procedure

First of all read your contract [assuming you have one and were given it in the 13th week of your employment]- it's a Statement of Terms and Conditions of Employment. Read what it says about overtime and when it's paid. Don't say anything until you are sure you are correct and your overtime has been withheld.

I don't know how your company works, but if you have a payroll department go there first to ask what their records show on your overtime hours. Ask them why you haven't been paid. Do your investigation before complaining to your employer. Make notes so you don't forget what you have been told.

Now, if you're still not happy, first of all ask to speak to your employer - a letter is far too formal at this stage and may trigger off a negative or judgemental response from your employer. Best to keep it on good terms. Take your notes along, list of hours and dates you worked overtime, when you expected to be paid - the wages department will have explained this - hopefully, and say that you would be grateful to receive the payment a.s.a.p. because of Christmas coming up.

If you don't get a good response and your contract shows you have a case, then I think rather than write a letter to your employer talk to someone at your local ACAS office [Arbitration & Conciliation Advisory Service] their advice is free and that's what they're there for. They will tell you what to do next.

Before you write your grievance, make sure there is nothing in your contract or any other procedure stating that you get paid your overtime onw month in lieu.... because thats what they do where I work.

Other than that, these days a grievance does not need to be too formal... just write something like...

Dear ......

RE: Formal Grievance

I am writing to complain about my wages. I have not been paid my overtime payments in my November salary and have been told that I will have to wait until December. I believe this is unacceptable.

Yours sincerely,

.....


It is that simple! Then they will investigate the issue and should reply to you in writing setting out the details of their investigation.

You contact the union rep for your department to have the union file a greivance against the company

You use your employment contract that specificies how you wlil be paid.

You write a formal letter complaining to the human resourse department

Ah, Jonas, he can't be forced. Even a union cannot force him to pay your wages into a bank. So sorry. good Luck!
