I recently had a case management conference,for a personal injury lawsuit.What are the chances of me receiving a settlement instead of taking this to trial? Also, is my lawyer required to notify me if they have made any offers to settle?

I was involved in a auto accident.I waited at the stop light and when the light turned green I proceed.One witness is saying the other driver ran the light,the other is saying I ran the light.

Neither the insurance company nor your attorney want this thing to go to trial. It is costly and most often times cheaper for the insurance company just to pay you to go away. Chances are very great that if you present them with a reasonable demand, they will meet you with a reasonable offer. If you are unreasonable, you will end up in trial.

And yes, your attorney has to make every offer to settle known to you.

[edit] Also remember, probably part of your agreement states that you will be responsible for reimbursing your attorney for expense incurred. These can kill your settlement offer. Things like postage, copying, deposition expenses, expert expenses, all are very very costly.

been there, done that. depending on what your case is and what happened in the case management conference will determine whether a settlement can be reached or not. if they are willing to settle, chances are if you can hold out, you'll get more. it's a personal decision. do you need the funds asap, or are you able to wait possibly 6 months or more for a greater chance of more money? your attorney would be able to advise you. as your attorney is obligated to notify you of any settlement offers.

The only people who know the chances of your case settling would be your attorney and the other sides attorney. A case management conference doesn't really deal too much with a settlement. Your attorney will notify you of any settlement offer I assure you.
