It depends on the state. As far as telephone conversations, most places only require one party to concent to the taping. Performances may or may not be taped. Most professional singers and speakers will not allow unauthorized recordings. Taping a teacher's lecture is usually no big deal.
What can be done with the tape really dependson your intentions. If you are selling copies of the tape, you have to compensate all parties involved. If you are using it in court, you better have a lawyer explain what can or can not be done.

Taping someone without his consent is illegal because it is an intrusion into the freedom of speech and a violation of the constitution.

Yes, if you're in the U.S. the FCC says that the conversation can be recorded if an audible tone is emitted at regular intervals. It is recommended that you follow the call recording guidelines of the stricter state when recording calls between states.
