Just wondering because I have soooo many adults that come into my convienient store and want to buy cigs or beer and I ID them because I have to ask if they look 40 or younger and I cannot make the sale to them because they don't have an ID and I can't back out of this. Others have told me that this law exists and that you can be cited for not having ID but just wondering.... by the way I live in Northern California...

Yes. ALL persons in the stae of California that are over the age of 18 must have a valid ID on them at all times. IF an oficer requests to see it, it must be presented...not having one CAN result in arrest, unless the officer can be convinced that the ID had been recently stolen or lost and the person is simply watiing for the replacement to arrive in the mail (which can take up to 30 days here in sunny CA.) although even then they should have something from the issuing agency stating that a new one has been purhcasd and is in the processing stage. NOW, in the current political climate, not having an ID is sufficient probable cause for arrest...

I'm not sure about local ordinances but the Supreme court ruled in 1983 that because a person has no ID, that it's not sufficient reason to arrest a person for loitering or vagrancy (what the whole No ID thing was about).

i don't live in NC so I don't know. Adults know when they buy something at the store that needs ID that they in fact need ID so stick to your guns. You would have to ask a cop in NC if that's true.

No, it is not illegal to carry id on you. otherwise teenagers could be thrown in jail lol. you need id to purchase items such as booze and cigarettes, but this law does not exist. except for in cars, police can ticket you for not producing you license

It's not illegal in that you can't go to jail or be fined, but the police have to right to detain you until they can verify your identity. Also, presumably some of the people who came to your store drove there; in which case it's illegal for them not have their drivers license on them.

you have to have id now. it's the law, or you're a terrorist and can be sent to jail, not collect 200, no phone clal to a lawyer, and no trial.
