That is if you are pursuing the matter without an attorney. What do you do? What is the basic procedure? I guess you first send them a letter to explain what that you intend to sue them as they have violated such and such law or code and that you would like them to pay you damages monies. They write back to tell you to 'go jump' then you get an attorney or other person to file a summons about the matter so that they must appear in court? is that about it? I am trying to do this but I dont want to do the wrong thing.

Get the "Rules Of Procedure for your local" court.
The process is usually laid out in PAINSTAKING detail

For example here are rules in PA:

You really need to get an attorney. Rules of civil procedure whether state or federal are going to be impossible to comply with if you don't have an attorney. There's just too much you would need to know to even bring the suit let alone try it. You would need to know the substantive law, rules of evidence, reasons why court would have jurisdiction, etc... If you don't have a lawyer, it will be too easy for the opposing party to get your case dismissed (if you don't inadvertently do it yourself). To be honest, you would never get your case off the ground. You really need to get a lawyer.
