Should a woman be held leagaly responsable if her drinking alcohol, smoking, or abusing drugs during pregnancy harms her child and Should she be liable for harm coming to her fetus from any of these substances or oly the substances that are illigal?

Yes,I think she should be held responsible.There have been cases against mothers whose babies were born with fetal alcohol syndrome.It makes me ill to see an expectant mother doing these things to her unborn child.Makes me wonder what kind of mother she will be if she can't even take care of her child before it is born.

There is already laws if a baby is born addicted to drugs... as far as smoke and alcohol, I don't know if they could prove the harm to the fetus came from those substances-I do think she should be liable.. I just think the reason there are no laws with it, is it must be hard to prove- I think with Fetal alcohol syndrome a baby can get that at any time during pregnancy so if a woman said that she had drinks before she found out she was pregnant they would have to take her word for it... Lots of things can go wrong with a pregnancy without any substance abuse.. so it would be unfair to blame a woman for something she might not have done

I believe that she should be held reliable for all substances legal and illegal; however, legal substances can only give a surgeon general's warning. A woman has the right to choose amongst legal substances. In the case of illegal substances, a woman might be brought before court and be charged of possesion of illegal substances and given a larger punishment for being pregnant.

She should. I think it's a great idea. Check all of the above. Here is something on the effects of alcohol:

YES! She knows she is pregnant and what doing those things will do to her baby. That baby has no say over what she puts into her body, therefore has no control of what it does. She is responsible for both of them.

Damn right! In addition to possession and being under the influence, she should be charged for endangerment.
