worker signed contract with former employer not to do specific type of work if he opened his own business, he rsigned from company and went to work for another company doing the same job, now his former employer is consulting with lawyers.

I would wait for the lawyers to give you the answer since they have the document in front of them. However it sounds like he accepted another position, he did not start up his own business, so you don't have anything to be upset about! Missouri is also a Right to Work State, it's a toss-up as to whether any employer can prohibit a FORMER employee from doing any type of work they want to do. There may be a non-compete agreement for a direct competitor, but that doesn't appear to be the case here
