A prenup is a contract that two people sign before getting married to keep pre-marital property separate in the event of a divorce. In order for there to be a valid prenup, there must be full disclosure of assets, no fraud, and it has it be done willingly.

Prenups can only govern what was earned before the marriage, not during the marriage. Even though you can try (note: I said TRY) to put a cap on how much a person may receive as spousal support, that normally will not fly in the event of a divorce. You can also try to put how much child support the spouse with custody may receive but once again that normally will not be held as valid. And as you can imagine, bogus clauses about how much weight you can gain, how much sex you will have, or the cap on how many children you can have are totally invalid.

If there's a valid prenup, in the event of a divorce the assets gained in the marriage will either be equitably distributed (meaning it's not totally 50/50- one partner may get more based on who is the disadvantaged party) or if you live in one of nine community property states, everything gets split down the middle without looking at who is the disadvantaged party.

DON'T BE FOOLED- everyone needs a prenup, not just rich people. Like Chris Rock said: "If you're making 30 Million a year and your ex wants 15, you're not starving. But if you're making 30K and your wife wants 15, you may have to kill her." The killing this is a joke. I do not advocate murdering people.

This is a legal document you get a lawyer to draw up before you get married. Usually it's done by wealthy people or people who have been married before and had kids. It protects the assets of the person if the marriage doesn't work out. For example, it could say that everything each partner has coming into the marriage, will not be considered marital property and if the marriage doesn't work, that money/property will revert back to the original owner. Hollywood stars need prenups to protect their assets when they marry fools.

A Prenup ! It's when you get married,you and your spouce sign papers stateing thet if by chance you ever get devorce'd,your spouce can not take any thing from you (thing's thet were your's BEFOR you got married) . If you had million's of dollers befor you got married, your spouce can not try to clame any of it when you get devorced.I think that go's for property also. Alot of people get real affended if there asked to sign prenup paper's.Sometimes it has even end'ed the relationship !

A "prenup" is a before (pre) agreement about nuptials (marriage) and represents an agreement signed by both marriage-to-be partners which defines the disposal of combined and separate assets and liabilities and post divorce earnings or income split after a formal divorce is finalized.(should the marriage come to that)

it is a binding legal agreement that states what each person has going into that marriage so in case you guys get a divorce then you will not have to split up the things that were valuable to you when you went into the marriage (family heirlooms, trustfunds, bonds, other money, etc.) in the prenup there are resctictons and stipulations.....

An agreement signed between the bride and the groom before getting married. It may contain anything but it should be done before a lawyer. Remember, this is not a necessity and may have no legal power.

For a pre-nup to be legally binding in court, in case of divorce, each party must fully consent to it, both must have separate legal representation, neither one is to be under duress or under pressure to sign one, and they must reveal 100% of their assets.

If I had gotten one (I am poor and was TOLD he was also) then I'd have seen this crap coming. My stbx kept all the pre-marital property (his home, boat, 5 new cars, 125 acres of land) a secret. This secret crap had mortgages, payments, etc. that sucked up ALL his "known" income. I was left to foot the bill for our rent, furniture, etc.

Get a pre-nup people! The "invisible ones" may be "legal" but they are far more damaging and deceitful that to know UPFRONT.
