The Constitution is. No law shall be higher than the Constitution. The Constitution overrides all laws (local, state, federal), and anything that's amended to it automatically becomes so.

The Supremacy Clause. No law passed by the federal government or state government or local governments shall go against the Constitution in any mannor.
Bush either doesn't know this or just doesn't care.
