I am currently on workmans compensation in Lousiana. I do not have an attorney,because I can't afford for the 20% that the lawyers take every week. I only get $86.63 a week. I am told that is because I made little over minimum wage. If I would have made $450.00 A week the financial settlement would be grander. I fell on a wet floor and hurt my back. I need an operation to repair the five bulging disc in my back as a result of the fall. And workmans compensation has offered me a settlement that would not even pay for the operation. I need to know what are my rights pertaining to this. I think that is totally discrimanative and prejudical. If I were making more money I would be worthy of an operation or a good settlement to help me get my life back in order. I'm very depressed because of this and the pain is chronic and constant. PLEASE! help me to find out if this is true or just something that the insurance is telling me to get me to settle for less than what my injury is worth.

I think you would be wise to consult a lawyer who specializes in Workman's comp cases. In fact it sounds like you cannot afford to go without one. They may be able to get you the cost of the medical bills plus a settlement. Good luck.

You let the workmans comp do their part and pay for the medical that needs to be done and you collect your workman comp while you are off work- in the mean time get a lawyer that will charge you nothing until you collect a settlement- when the settlement is collected- then the lawyer is paid- not before-and it id usually 30%- and is not related to social security disability- that is a another story-D
