Depends on what the age of consent is in the state they live in.
With that particular age, no, it probably wouldn't be considered statutory rape, unless her parents really had a cow about it.
On the other hand, you are under the age of consent in all 50 states, and anyone who is over the age of consent having sex with you could be charged with statutory rape.
Statutory rape is a little different from actual rape. A person charged with statutory rape is charged with that because the person they had sex with is under the age of consent - which means that no matter whether there was a "yes" or a "no", that person is too young to give an answer, so it's considered statutory rape. The question of whether there was consent or not is completely irrelevant, because the person is too young to legally give consent to have sex. (I know it seems like a stupid law, but it's there to protect you.) Rape is when one person forces sexual intercourse on another person, and there was no consent.
I hope this clears things up for you a little bit.
I hope very much that you talk to your mom before you actually have sex. And that when you do, it will be with someone you love and that loves you. It takes a long time to figure out the difference between lust and love, and I've only just figured it out in the last year or so, and I'm 19. I made a lot of mistakes to get to where I am now. I wish I could just tell you not to make the same mistakes as I have, but I also know that you won't understand why you're not making them if you don't make some mistakes yourself. (This is pretty much what I would tell my 14 year old daughter, if I had one.)
I hope this answered your question, hon.

If the sex is consentual by both involved it is not rape.meaning..both persons agree and both are of sound mind and body..neither under the influence of any state altering substances..i.e.alcohol,drugs etc.Statuatory rape though is when one person is a minor and the other over 18 yrs old.You may be then looking at the laws on statuatory rape. That is where both parties agree but one is under the age of eighteen and the other is over 18 yrs old. Laws and consenting age vary from state to state. You should be able to find the consent age in your state by looking up state statues , laws and codes in ___. whatever state your in.Please let me just say though if you are considering having sex or are sexually involved with anyone. Please think about what you are doing? There is all the time for that later. Sex complicates a young person's life immensly, hmm even complicates us when we are older.lol.

Depends on the state. From my understanding, it is 16 and under that it is statutory rape. You are asking this question because you want to have sex or you already have. Sex feels good, but it is overrated and has so many setbacks and risks. Babies, STD's, infections, etc.
Abstinence is better. Having sex makes people more possessive of the person they had sex with and they act crazy when the other person wants to be with someone else. Too much drama too have sex with someone who doesn't want to marry you.

Rape only occurs when it's against your will and you've told the guy NO. In this situation, it appears to be concentual. If the guy were over 18 and the girl 16, or younger, then it would also be considered rape.

Well in Virginia the law says that if you are a minor and have an adult boyfriend/girlfriend, he/she may only be 1 to 3 years younger than you.

It depends on the law where you live.
In some places, yes, that would be the case. It would be called "statutory rape" and it would put the adult on the list of sex offenders for life.

I don't know about the rape part, but I am 14 too, and commend you on the no sex before marriage idea.
I am Muslim so I am totally against it too.

this would be considered stagatory rape because she is a minor. If it was reported that he had sex whetherr consentual or not he could go to jail for it and be considered a petafile. that is the law in Illinois so you may look where you are!

Not likely to be considered rape because they are so close in age. It isn't like she is 13 .
