it doesnt seem fair but he wont GO and i cant take it anymore....i dont know what els to do. Any suggestions?

We are not married and he is not on the lease. he just makes excuses like i am throwing him out in the cold and he has no where to go........he has a job and a car.....and he yells at me when i tell him to get out like i am so wrong.

Ex-husband or boyfriend? If he has no legal claim over the house call the cops. If he does then leaving with your kids sounds like the only reasonable option.

You need to consult a lawyer before you do anything. There are certain rules regarding "abandonment", kidnapping, etc that could affect you later on down the line if you choose to do this. HOWEVER, if you or your children's safety is in danger because he is violent, then yes, you need to leave NOW, but if it is just that you two aren't getting along, you need to be careful of how you proceed so that your legal rights are protected. No matter how unreasonable it may seem, be sure to follow the law.

PS. These comments apply if he is your husband. If he's just a boyfriend, then you have other concerns. Also, be congizant of your responsibilities to lease agreements etc., that you may be responsible for.

I had an ex that would not go away. It went on forever. Eventually, I had his dad pick him and his sh!t up. All he said is "So this is it?" I said yes and has not spoken to him ever again. (I do speak to his parents when I see them-they are great)

to your details-he has a job-thenhe can get a new place. A lot of apts in my town have $99 move in specials. Do you have any muscle to help you get him out? Go to home depot and buy a lock. (deadbolt) They are not difficult to change. Pack his things nicely-not that he deserves it-you just don't need anymore b.s, and put them on the porch. Have your muscle stick around, or at least leave their car at your place a few days.

Go ahead and move out and file for divorce immediately. If you are under a lease, talk to the landlord to remove your name and explain that your husband has chosen to stay on. If you own a house with him, the court will probably grant you residence since you have children and it is always best for children to stay in the home they are used to. You can also talk with child protective services and explain the situation. They may help you get him out!

Contact your divorce attorney. The attorney can have a court order handed down and a nice deputy sheriff will help your ex pack a bag and depart the premises. Then change the locks and let nature take it's course.

You are doing the right thing before things turn ugly because he has shown you he has no morals or respect for himself especially when you have made it clear you want him out.

My next qestion would be are you two married if not make the rental office remove him legally go through the right channels to have him removed. For the safety of your children they deserve to be in a peaceful stress free enviroment

If the apartment is in both your names, he doesnt have to leave unless he wants to. If only in one name THAT person can stay and evict the other. If you are able to move and the place is not just in your name...I say move on and good luck!

I am going through the same thing, but my apartment is in my name. Try to prevent confrontation in front of your children, but my next step will be to throw all his crap in the street. Maybe then he will understand over means over.

Whose house is it? If it's his, you need to move out. If it's yours or yours together, do NOT leave under any circumstances.

If it's your house, have him evicted. Call the police.

If you own it jointly, see a lawyer but do not move out.

Take him to court, if you move out then what makes you think he will move? Either take him to court or call the cops, they will get him out.
