A: Three elements must be present to form a common law marriage in Texas.

First, you must have "agreed to be married."

Second, you must have "held yourselves out" as husband and wife. You must have represented to others that you were married to each other. As an example of this, you may have introduced you partner socially as "my husband," or you may have filed a joint income tax return.

Third, you must have lived together in this state as husband and wife.

There is no lenght of time for a common law marriage even though most people think it is 7 years.. some states do not even reconize common law marriage but in Texas there are the three things that will consider you as common law marriedTexas: A man and woman who want to establish a common-law marriage must sign a form provided by the county clerk. In addition, they must (1) agree to be married, (2) cohabit, and (3) represent to others that they are married.

The length of time required for CL marriage varies from state to state (assuming the state recongizes it at all, which TX does)

It's takes more than living together like the guys above said---you have to have all 3 of those things--like using his last name, filing taxes together, etc.....

Check with an attorney. In some states if you check into a motel and sign as "Mr & Mrs" you are representing yourself to the world as married and nature takes it's course.

6 years in Maine to be married commonly........the trick to that is you and live apart for awhile 6 months and then get back together.

thats not true it used to be but now you have to live with someone for 5yrs to be considered common law married
