Does a taxi driver have the legal right to record conversations of fares that make the driver uncomfortable?

The use of surveillance equipment in your taxi (your place of business) is the same as its use in any other place of business and the same restrictions (depending on your state) would apply.

He has to inform the fares that he is recording the conversation and have THAT conversation and their agreement on record. He cannot simply tape any fare he feels like and then use it against that person.

"Uncomfortable" is fairly broad too... if you hear a conversation about killing someone you are duty bound to report it. If you hear a conversation about kids cheating on a test, I'd suggest you tune out.

No.. they can only take your picture when entering the cab.... I'd say that is a problem. but if they do they should tell the customer that is what is being done. Cause if not then it is not legible in court.
Cause even if the customer has seen it on the dash board doesn't mean that it will register in their head that the conversation is being taped.

What a great idea! If you keep the recorder up on the dashboard where anyone can see it you would not be taping in secret.
