My son just started working in a family type restaurant in Orange County, CA. He tells me that they are keeping part of his pay at the end of the day. As he explains it, if he makes $200 worth of business in his designated area each night, and he makes $40 in tips, the Restaurant keeps about 20%? I have not heard of this law and perhaps he is not clear as to why. I've asked him to talk to his manager and have them explain this to him. I have been a waiter when I was younger and then in my profesional career I have been in management so I thought I was thoroughly knowledgable about labor laws. This one threw me for a loop, I am familiar with tip laws but not having an employer withhold additional tip money from their employers. Any ideas outhere?
