In court, my sisters were awarded £1805. We paid £400, they kept our property - £1250, must I pay any more?

My sister rented a flat to me and my wife. We paid rent every month, but when we had a problem, e.g.server flooding, my sister refused to do anything. When we left the property, she claimed she had no knowledge we were leaving, and attacked us over the phone because the of the state of the flat - I repaired most of the wallpaper but there was nothing I could do with the carpet. She racially abused my partner on the phone and threatened us. We went to the police because we were scared as she has a history of violence. She later took us to court claimining £5000,and was awarded £1805. We have paid £400 but although she agreed to let us have our property worth £1250, she has denied us access, and won't answer us, even through a solicitor. Can we ignore any further payments to her as she has has £400 plus has kept property worth £1250. I don't think we should be liable for anything else, what does anyone else think? Should we pay? We don't have the money!

I am using my wife's yahoo account. Basically she is refusing to help with the payments, alos calling me a coward for paying the £400 already...I just want our lives to move on, she wants to drag this out and gets personal attacks in on me, ot very nice is it?

Hi Rachael,

This has now become two issues. The money and your property, the first of which has been decided on by the court. You must keep paying the money off unfortunately.

As for your property, she has no right to keep it. All you have to do is get a court order to gain entry to the property to retrieve your belongings.

She should be reminded that to permanently deprive the legal owner of their property is theft.
