Given they are
all normal kids with 1 head & 2 legs each
and all normal dogs with 1 head & 4 legs each,
the man saw all the dogs & kids out at that time there are
8 dogs (with 32 legs total) and 4 kids (with 8 legs total)

This is not a biology question. It is a math question.
We know two things, let's translate to equations:
Say K is the number of kids, D is the number of dogs.
K + D = 12
K*2 + D* 4 = 40
So
(12 - D) *2 + D * 4 = 40
24 - 2D +4D = 40
2D = 16
D = 8
K = 12- D = 4
So 4 kids, 8 dogs.

d+h=12
Multiply 2nd equation by 4 . . . 4d+4h=48
Subtract the first equation from this one
4d+4h=48
- (4d+2h=40)
2h = 8
h=4 humans
4+d=12
d=8 dogs
