I signed an application for an apartment and paid $100 to reserve the apartment. I specifically asked for the first floor.
After I signed the contract with the first floor on it and became approved for the apartment, they immediately changed me to the second floor without my permission. In fact, they left a voice message after closing letting me know I am on the 2nd floor.
Is this illegal? I signed a contract and paid $100 for the first floor to be reserved.

On the contract that I signed and PAID money to reserve it, the first floor apartment number is written on the contract.

You can re-neg the deal. Usually, around here and most places the second floor is a little more expensive. Not always, I prefer the first floor usually. The disadvantage to the first floor is usually higher likely hood of break-in and possibility of insect infestation. Ask them why they decided to relocate you, and go from there. GL

No, you can back out and get your deposit back. This is called a "bait and switch" maneuver.
