I have 2 daughters that are now 15 and 14 years old and their father has never been apart of their lives and has never paid child support. He is currently incarcerated.

Your local prosecuting attorney's office usually has a person that is responsible for child support cases. Because he is in jail does not negate his obligations to pay child support. The amount usually continues to acrue. However, as long as he is in jail, he won't be expected to pay anything (unless a judge orders a garnishment of any of his funds earned in prison). But I would go ahead and file with the court. Sounds like he's a real bum anyway and you probably won't collect. HOWEVER, you can push the effort and he can be put back in jail for failure to pay his child support. Call your Prosecutor and ask.

I suggest you seek a lawyer, you (well the girls) are entitled to back child support from when you two spilt up as well as regular monthly payments until they are at least 18, or 21 depending on which state you are in. I don't know how they would go about getting child support from him in jail, a lawyer can help with that but you really need to file the girls deserve to be supported by BOTH parents.

If I were you, I would think twice about filing for child support. If you do, this will enrage the father and if he has family he may try to get them to file for visitation. This will upset your life and your dauther's lives as well. I speak from experience. I say, "don't rock the boat".

How can you collect money from him if he's in prison??? Can't get blood from a stone...

my advice is this: If he's never been a part of their life and never paid support and he's in jail, then let it go. He's obviously a bum and you and your girls are better off having nothing to do with him or his money...

You need to call and talk to your nearest child support enforcement agency CSEA for answers. You can look them up on the internet for the CSEA in your area.
