You should ask a constitutional lawyer, but from my recollection of constitutional law, racial discrimination is not unconstitutional (this has NEVER been the case) - only certain types of racial discrimination are unconstitutional. The last time I checked, it is not unconstitutional for a school to discriminate in favor of African-Americans (read: affirmative action) because, although members of other races have an equal protection/due process right, the state has an overriding signfiicant interest in redressing a historical injustices resulting in modern disadvantages. (The name of the Supreme Court case from the 1970s is Bakke.) However, as I understand it, the Fifth Circuit Court of Appeals has partially overturned this interpretation in a case involving the University of Texas School of Law in the late 1990s. (The name of the case was Hopwood, and the Supreme Court denied cert.) Right or wrong - that is the law.
As a student of history, I can tell you that the answerer above who indicated that there were more Irish and Chinese slaves than there ever were black slaves in the U.S. is WRONG. For most of the pre-Civil War 1800s, based on actual census data (NOTE: slaveowners had an incentive to accurately report the number of slaves they owned for tax purposes) a majority of the populations of many of the southern states were black slaves - i.e., there were more slaves than freemen in those states. I would suggest that the "history books" he is relying upon are probably the same ones that indicate the Holocaust never happened.

No you wont be able to. The Supreme Court already ruled its legal to exclude whites based on race. Race shouldnt even be considered at all in the admissions process, hiring process or at all in this country. We cant have true equality until we totally abolish anything that denotes a separtaion because of race. This includes Affirmative Action, ACLU, the NAACP, NAAWP, and any other special interest groups that have anything to do with race. As long as these groups exist we are drawing attention to our differences, even if their intentions are good in threory. No emphasis should be put on race at all. Im a rarity in this country, Im truly white. Ive traced my lineage back to 1100AD and we are totally European by race. IF anyone has a claim to be white I do. Also Im Scottish in heritage. History books dont tell you that there were more Irish and Scottish and Chinese slaves in this country then there ever were blacks, but you never hear us complain, or create special interest groups against the White Man because of how we were wronged. No we just continue on taking responsibilty for our own selves and working like everyone else, harder even than most these days, to make it in this crappy economy. We manage to do this WITHOUT complaining and WITHOUT all the "extra" rights that go with being a minority. I say sue the college, make a huge stink, get media coverage and at the least make a statement.

Racists ( of any color ) are the scum of the earth ! and racist activity is despicable no one should be excluded from anything because of the color of ones skin , I don't see why you should not be able to file a law suit , go for it ! I'm sure you could find a lawyer to take this on , what city are you in ?

Before you initiate a lawsuit, at least one that a reputable attorney would handle, you may want to investigate why you were denied in the first place. Most colleges and universities, as you're probably aware, have admission criteria that focus on academic performance, letters of recommendation, test scores, etc. If you were denied on that basis, then your lawsuit would be frivolous.

Have you ever been on the campus of a black college? The students are not only black. There are students of all races at every black college. If you didn't get accepted, it's probably due more to your grades than your ethinicity!

Go for it....
Do you have the letter they sent you (on college letterhead) stating it is because you are white and you can prove it was mailed to you from the university in the correct timeframe?
Your lawyer will need to use it as evidence...... He needs more than "feelings" to go on. Dates, times, conversations, paper trail, the specific reason for your belief, etc

Sure you could file one. You might want to check the legal history and standing of black colleges before you do it, though. I really, really doubt you're the first person to think of this.

I wonder, which college would this be? Most HBCUs (Historically black colleges and universities) are not all black at all. They are mostly black, but not all. So which one denied you?
