Recentely, we were in the gym locker room. My friend, we'll call him Tom, had his cell phone. My other friend, we'll say Jeff, picked it up and started playing with it. We're not little fags, so Tom didn't freak out or anything. (we're all 13 btw.) Jeff takes a picture of a kid; fully clothed. The kid than begins to freak out saying things like "What the **** did you just do? What the ****????!!" And trys to hit Jeff, but is so puny and weak it does nothing. The kid, also 13 years, begins hysterically crying and asking "Why did you take a picture of me!!?" and just totally freaking out. He tells the gym teachers, and they bring Jeff into their office. I don't know what happened in the office, but Jeff gets a 3-day out of school suspension. Can anyone tell me any possible objection the teachers could've found to punish him so harshley?

Thanks.

That makes sense, but I think it might be a little bit extreme nonetheless.

You have to use your imagination.

Let's say the school didn't punish him harshly, just kind of let him off with a warning.

Then let's say that all of a sudden a nude picture of Tom, in the school locker room showed up on the internet, and somehow the picture was traced back to Jeff's e-mail account. That's felony child pornography. Maybe Tom had taken the picture the day before or the day after, maybe he took it the same day and managed to hide it, who knows?

Now imagine that Tom's parents found out about the naked picture of their 13 year old son on the internet, clearly taken in the school locker room. They would probably get a lawyer and sue the school, right?

In court their lawyer asks the principal,

1) Did you know that Jeff was taking pictures of others in the locker room, where the young boys change and are naked?

Answer: Yes

2) When you found out Jeff was taking pictures of others in the locker room, where young boys are naked, what did you do?

Answer: I gave him a warning.

Do you see how a jury might think the principal or teachers kind of let this child pornography happen by not punishing it harshly the minute they found out about it? If they win the lawsuit, then the school is going to have to pay the parents of that kid LOT$$$$ of money. And you will be not getting that nice new chemistry book you need next year.

Probably just to set an example, which is sad and sometimes thats the only way to keep kids in line... this wil in the future let others know taking someone photo without theit permission will not be tolerated... especially in a locker room... it was a good thing the kid was dressed ... jeff could have been expelled if the kid had been sorta naked???... I and you know there was no harm intended but you have to realize the responsibilities of school officials now days... to keep things under control... That's how it is and there's nothing we can do... so whether it was right or wrong doesn't matter... it was an invasion of privacy in the eyes of the kids right.
