I moved in the beginning of November. Besides the cockroaches in the kitchen and ants in the bathroom (and other various issues), the worst thing is the upstairs neighbors are inconsiderate clods who walk like Clydesdales when they're home. Sometimes it's as if they're having a ho-down up there. They have zero consideration that someone lives below them and it's literally unbearable living there. I want out but I still have 11 months on my lease. There's no way I could still live there for another 11 months, I get headaches from the pounding. My landlord STILL hasn't given me a copy of my lease ("I have to go through paperwork" he says). I know I can't just leave and I want all my deposit back. The landlord is like a car dealer, he's a shady character with a fake smile who never gives an honest answer about anything, besides being an irresponsible buffoon. What are my options here?

Try to ask him nicely and indicate that you will help get someone else in, and do so. If that doesn't work, don't pay rent until it equals your security deposit, then move out. (I suggest the first option) This route also backfires sometimes. I am a landlord with lots of properties and I truly feel the best way is to let your landlord know all the details. Take him/her out to lunch or dinner and explain the problem and what you would like to do. Good luck!

You can call the Los Angeles County Health Dept. on him for the roaches. You can also call Legal Aid and ask for someone that knows about landlord/tenant law. If you like you can also visit the law library (call the county superior court and ask them where it is if you dont know already) and you can look up information yourself.

There are a few books out there that you can get at the law library or buy at barnes and noble with lots of info geared towards renters rights. E-mail me if you would a link or more info reguarding the books.
