There hasn't been an actual Witch trial in the U.S. since the mid 1950s, when a woman was accused of that an acquitted. It was attempted again in the late '70s/early '80s and got laughed out of court. So, until you can produce empirical evidence that such a spell would actually work, then an emphatic NO.

With a death spell I wouldn't worry about being legally punished! The fall out, the karma, the chance of the other person's shield being stronger than the spell ( if you believe in such things) would be far more scary than a cop knocking on the door.
Now if this spell was done so that the person being cursed could hear it or otherwise know that it was done, then, the way things are now day's I'm betting the spell caster could be up on a charge of terrorist threats at the least.
Generally speaking it just isn't a good thing, spiritually, to wish death on another being.

What your talking about is the reason that they made Wicca. Not to long ago people were afraid that witches might do just that. It was not until the 1970's that it became legal to practice witchcraft.
If you can or know someone who can then why would you? At the point that you learn "real" magic you also know how that it is wrong to hurt. The "real" truth is that someone able to do this would never brag or boast about it. Also they would never do this as it would harm their other witches.

Spells are merely wishes that the users are hoping will come to pass by performing a ritual, kinda' like a prayer. As long as the person who wishes death upon another does no more than wish them dead, no law has been broken except the law of karma (which is not legally binding).

strangely enuff, YES! my dad says if you are a witch and cast a death spell on someone to their face, you could be charged with harrassment. this includes even if the witch just pretends to cast such a spell.

We live in America. We pride ourselves on our legal system. Anyone (you included) can be sued for anything. Doubt if it would be dismissed, but it may be considered harassment or assault (threats).
