I want to copy photos that I find online and use them to make things to give away. For example, I found one of a lady with her hand over her mouth and I want to write across it, Its been nice but I want to scream now. I am not making money on it, but it IS on a website that SELLS this photo. Can I do it or not?

You would have to check back on the site to determine if the image is copywrited or not. There are many pictures that are considered to be in the public domain. What this means is that they are coptwrite free and you can therefor use them for any purpose you wish. Copywrited images canot be used for ANY application without the express consent of the copywrite holder. However, if an image is significantly altered, it becomes a new image as it can no longer be confused with the origional one.

best thing is to take that same type of photo for your self, models are easy to get, and leave others intellectual property to them... you would not want to see that on a t-shirt which you didn't do now would you... even though it would be a good shirt with that saying that photo and saying on it.... so do your own work and be proud that it is all your work.... too much stealing of I.P. already as it is.... look at the number of people on this site that want someone else to do writing or researchfor them that they will then take credit for good luck with your venture you obviously have a wicked sense of Humor, now combine that with a sense of justice and fairplay and you will be kickin ***

al have to do is put a link to the photo just to cover ur butt becuz i drew a picture of someone elses work nto exact to the picture and they complained and liek found me on the internet and i dont even know them.... and didnt put a link soo put alink to the photos that or have a page with the original authors name of the photo or website u got it from just incase but uit shouldnt be aproblem if ur not seeling it, either wya it is plagerizing but so long as u provide a link or sya its not urs then its okay!

if they are selling it, it has a copyright and u r in danger of getting seued up to $250,000. no kidding!

i remember my friend who is a photographer and once he found out a website is displaying 5 of his photos without his permission.
before he sues the guy, he got $30k to settle the issue. no court nothing! easy money!!
he just faxed them his copyright certificate from Library of congress! that's it!
so these thing are very serious.

im not sure it legal or not, but as long as you keep it personal and dont sell it or such things i dont think there will be a problem
