if a person dies intestate the estaste goes to the children, if no children then it will go to the parents of the deceased

First...see a lawyer. I'm not one. Generally, the surviving spouse gets everything. If there is no spouse, the kids. No kids, the parents. No parents, siblings. Finally, if there are no provable heirs, it goes to the state. That is *generally* how it goes, but your situation may have others involved.

It Depends on how Texas law reads, generally if he dies and has a wife and kids, then wife gets most everything, but kids are still entitled to a portion as well. If no current wife, then everything to the kids, if no wife or kids, then to his parents, if no parents, to brothers and sisters or their kids. All depends on Texas State law. You can go to a Law Library and look up under intestate decent or your best bet is to contact a lawyer in texas in your area who handles probate work.
